The Division Engineer is claiming that the reservoir storage is not as large as those stated <br />in the absolute decrees. With the exception of 2002, the water supplied by the contributing basin has <br />provided enough water to compensate for the missing storage. <br /> <br />ReseNoir No. 4 <br /> <br />Reservoir NO.4 is located on the west branch of Bull Creek above Bull Creek Reservoir NO.3 and Big <br />Beaver Reservoir. The Reservoir is located within the Grand Mesa National Forest. The Division <br />Engineer is not arguing the capacity of this reservoir, however due to a fill restriction on the reservoir <br />resulting from a substandard dam crest width, has caused a reduction in allowable storage. This <br />unused storage is a portion of the 229 ac-ft that is subject to abandonment. In addition, a 2003 Dam <br />Safety Inspection report has indicted a potentially high phreatic water level, which may create an <br />unstable embankment and further reduce the reservoir's capacity. <br /> <br />Stipulation and Agreement <br /> <br />The Stipulation and Agreement, dated October 2003, has established that "By October 31, 2004 the <br />Company must demonstrate the available storage capacity by submitting storage capacity tables for <br />each reservoir..". The Agreement aiso states that.. .If the Division Engineer determines that {Company} <br />diligently performed all actions necessary to complete said project, the Division Engineer may in his <br />discretion, amend the Agreement to extend the deadline if request is made by October 1, 2004. Thea <br />Company has submitted a request for extension to the SEO. The Division Engineer will review the _ <br />request and determine if the Company's schedule and repair recommendations meet the Agreement <br />requirements. If the Company does not meet the Agreement requirements by the deadline or extended <br />deadline, the Division Engineer may file a petition to abandon the storage right amounts described <br />above. <br /> <br />Feasibilitv Study <br /> <br />Paul Currier, P.E., Water Resource Consultants, LLC of Rifle, has completed the feasibility study in <br />accordance with CWCB guidelines. The study includes survey information and cross sections, which <br />have been used to provide a cost estimate. Garrett Jackson, P.E., Dam Safety Engineer and John <br />Sikora, P.E., Assistant Division Engineer (Division 5) have provided valuable input regarding the <br />corrective actions necessary and will review progress by the Company toward Agreement compliance. <br /> <br />The Bull Creek Reservoir. Canal & Power ComDanv <br /> <br />The Company is located in the Town of Mesa, approximately 30 miles east of Grand Junction. The <br />Company provides 850 ac-ft of irrigation water to approximately 800 acres of agricultural land primarily <br />'used for cattle ranching. The Company was registered in the State of Colorado in 1895 and is a non- <br />profit corporation in good standing. The Company has the power to set member's annual assessments, <br />cut off water deliveries to shareholders that fail to pay assessments, and sell stock to pay back <br />assessments. <br /> <br />e <br />
