The three reservoirs are located near the headwaters of Bull Creek in Mesa County <br />and are identified as Bull Creek Reservoir Nos.1, 2 and 4. The Bull Creek Reservoir Nos. 1, 2 and 4 <br />Rehabilitation and Enlargement (Project) will include the planning; engineering; and construction <br />required to rehabilitate and enlarge these reservoirs. The Project is a necessary action by the Company <br />to comply with a Stipulation and Agreement dated October 31,2003, with the State Engineers Office <br />(SEO) that requires the Company to increase the storage capacity of the Company's reservoirs to avoid <br />abandonment of approximately 229 acre-feet of decreed water rights. See attached Project Data Sheet. <br /> <br />Backqround <br /> <br />The Company has operated five reservoirs (Bull Creek Reservoirs 1 through 5) for nearly 100 years. <br />This Project is the result of an agreement between the SEO/Division Engineer (Division 5) and the <br />Company to restore volume to three of the Company's reservoirs. The Project will: <br /> <br />1) Recover senior water rights effected by a Division Engineer 2001 filing for decennial <br />abandonment which claimed less storage existed than decreed absolute for Reservoir Nos. 1 & <br />No.2' <br />2) Remove a fill restriction imposed by the State Engineers Office (SEO) on Reservoir No.4, which <br />has also resulted in a filing by the Division Engineer for partial abandonment of senior water <br />rights. <br />3) Address the potential for additional fill restrictions of Reservoir No.4 due to seepage concerns, <br />which were identified by a 2003 dam safety inspection. <br /> <br />Flood Protection.
