Introduction
At the November 6-7, 1995 Board Meeting, approval was given by the Board to gnmt requests for
easements in CWCB's right-of-way along the Chatfield Downstream Channel Improvement Project
(Project) on a case-by-case basis. In addition, at the November 21, 2001 Board Meeting, the Board
adopted the "Easement Guidelines for the Chatfield Downstream Channel Improvement Project" dated
November 200 I.

At the May 2005 CWCB meeting, Board membets approved changes to the Easement Fee Structure
such that: I) the S1andard easement review fee, to be paid by the appliC<lllt to the CWCB, is now
$500.00; 2) fees collected are deposited in the South Plane Operational and Maintenance account for
specific use by the program; and (3) a new easement fee method was developed known as the easement
"Impact Method". The Impact method set the value of CWCB owned right-of-way at $lO.OOIsquare
foo~ and then quantifies various uses of CWCB lands as a percentage of the $1O.OOIsquare foot For
example, drainage pipes and sewer lines have a 50% impact while fences and paved surfaces have a
70%, impact

At the March 2005 CWCB Meeting Board Membets approved a request from Roxborough Park
Metropolitan Distric~ Littleton, Colorado (RPMD or District) to construct a 36" pipeline for
transmission of wastewater that will utilize the CWCB ROW lands. That request was approved and
provides the District an easement for the construction of a major Wastewater Regionalization Project in
Englewood and Littleton, Colorado. As part of the proposed project, RPMD will provide wastewater
service to Lockheed Martin Space S~tems (LMSS). Upon completion of the District's project, the
RPMD and LMSS treatment plant will be closed which will eliminate any future phosphorus and other
nutrients discharges into Chatfield Reservoir. This action should assist in the overall improvement of
the water quality in Chatfield Reservoir. The proposed project will cross, parallel arxl traverse nearly the
entire length of Board's South Plane River Right-of-Way (ROW). The CWCB recommendation ...,.as
for a 20' pennanent and 40' floating construction easement for this waste water pipeline set at a
$50.000 fee. CWCB staff is encomaging RPMD wor!< cooperatively with the Corps and the Urban
Drainage and Flood Control District (UDFCD) in the design and siting of this waste water pipeline.
