The reservoir is located about 13
miles northeast of Trinidad in Las Animas County. Please see the attached map.

The Company's engineerin{1 consultant, URS Greiner Woodward-Clyde, submitted a draft
feasibility study on May 20 . Staff is still in the process of reviewing the feasibility study and
discussing the technical and financial aspects of the project with the Company's representatives
and consultants in order to be able to make a final determination of feasibility.

Back2round

Model Reservoir is a regulating reservoir used to store water for the irrigation of about 6,000
acres of cropland below the dam. The water is used primarily by Oxley Fanns. Water supplies
originate from local runoff and from Purgatoire River water, which is stored in Trinidad
Reservoir. Reservoir capacity below the invert of the existing spillway is estimated at between
4,500 and 6,000 acre-feet.

During the storm event, which occurred earlier this month, a very large amount of runoff
originating in the local drainage basin flowed into Model Reservoir and overtopped the outlet
conduiton May 2nd. (An excavation for field analyses above the outlet conduit resulted in a
discharge elevation lower than the spillway crest.) The floodwaters damaged the outlet gate
tower and eroded a portion of the dam embankment. Because of the flood damages, the owners
