<br />132 <br /> <br />I <br /> <br />Mr. Saunders stated that the Act says.in Section 1. ~The <br />Colorado Water Conservation Board is hereby authorized and <br />directed forthwith to make, or cause to be made a study of <br />the water resources available from surface supplies in that <br />part of Colorado which lies west of the Continental Divide, <br />and a study of the present and potential uses thereof to <br />the full extent necessary to a unified and harmonious development <br />of those waters for beneficial use in Colorado the fullest ex- <br />tent possible under the law, including the law created by <br />compacts affecting the use of said water. The studies so to <br />be made shall include analyses of the extent to which water <br />may be transferred from one watershed to another within the <br />state without injury to the potential economic development <br />of the natural watershed from which water might be diverted <br />for the development of another watershed." That last <br />sentence contemplates that it might be necessary to describe <br />conditions under which that might be necessary, ~:r. Saunders <br />said. <br /> <br />~r. Dutcher reminded that "The Colorado Water Conservation <br />Board must at all times have this matter in its charge, it <br />has the responsibility of eventually determining what that <br />situation is. The Colorado Conference Committee certainly should <br />make some kind of a report and recommendation to the Board. Then <br />it should be up to the Board to act on thatrecommendation, as <br />done in the case of the Arkansas-Frying Pan Project." <br /> <br />Mr. Saunders stated that the language of the Act is <br />broad enough to authorize this Conference Committee to proceed <br />to gather the information which is necessary, and to present <br />to this Board for its consideration, with perhaps a tentative <br />finding, leaving it to the Board to make the final determination. <br />Give Conference Co~~ittee power to do the work we want it to get <br />done." <br /> <br />I <br /> <br />Mr. Dutcher thought we might get in "dutch" with the <br />Legislature unless this $100,000 is spent just exactly right. <br />Too much to delegate the entire power of the Board, he commented. <br /> <br />Mr. Saunders said he believed that at least :;);1,000 would <br />not be too much to give the Conference Committee, adding that <br />the Board cannot come back here and meet to rule on every small <br />expenditure tha Committee wants to make. <br /> <br />Mr. Crawford said, "The only discussion we have had with <br />the Attorney General was with )':r. Hinkley; \'le got his opinion <br />with regard to expenditures. Mr. Hinkley suggested that we <br />come back to the Board, but did say we had the implied power; <br />he advised however, that we come back to the Board and have <br />this resolution passed." <br />
