175

Mr. Dille stated, "Definition of a district is to be deter-
mined by the State Board, which in its description is an underground
basin. Viho is going to define such a basin?"

I

1.lr. Hinkley agreed that at least "Ie need some technical advice.

Mr. Hinderlider, who had returned to the meeting, said,
"Vie have been receiving requests from so-called shallow wells. Very
distinct difference in the two types of wells. Should we continue to
receive applications? If State Engineer does not have any authority
I want to know, as soon as possible, what to tell these fellows.
They are maki/'!g inquiries every few days."

Mr. Craw.ford reminded that "Defi/'!ition of a well, as used il'l
this Act, mGans "a method of obtaining water from an aquifer. Aquifer
means a geological formation or structure that transmits water."

Mr. Hinder1ider said he wanted to know whether he should advise
thesG applicants to file in his office, that inquiries are c.oming in
every day, that the fee goes into the treasury. The Act has not been
construed, so far as he is concerned. \~en we accept fees, he said, how
are we going to recompense the fellows?"

Mr. Breitet'.stein replied, "VeT'J regulatory .on the licensing of
well drillers .!'

Mr. Hinderlider stated it is adjudicated when we accept his fee.

Mr. Saunders advised making a record to have availllble.

Mr. Dutcp.Gr stated that a directive has been promulgated and
we have no alternative but to carry out the provisions of the Act.

Mr. Beaty commented that we are compelled to license these
operators and see that they have a bond.

Mr. Bailey remarked, "If we Cfln collect money and get a fund
before we make expenditures for geologists, etc., would this be all right?"

Mr. Dille asked whether these fees can be used by the Board.

I

Chairman Bailey replied that we .can use them; any time we get
excess over $10,000, we have to turn it back.

Mr. Saunders made the following statement: "Mr. Chairman, the
thing that impresses me is that here is a new burden on this Board,
which the Board ought not to have; it interferes with the L~portant work
that the Director has to do. The Director could get bogged down with the
administration of this thing, which is entirely apart from the historical
work of the Board. I think that Mr. Breitenstein made a very good sug-
gestion that the Director and. the Vice-Chairman of the Board call on the
Governor and ask for funds to be set up to employ some proper person or
persons to implement this program quite apart from the regular work.
