<br />Requires each public works plan to address the logistics of providing public works, including, but not <br />limited to: <br /> <br />Designation of the local governmental entity that shall be responsible for providing public workfS' <br />The expected funding source for the public works; and <br />The local governmental entity that shall be responsible for the construction, maintenance, an <br />repair of any infrastructure that is necessary for the provision of public works. <br />States the date by which any county or municipality that is required to create a public works plan shall <br />create and implement such plan. <br />Requires each local government that has implemented a public works plan to periodically review such <br />plan and make any necessary revisions. <br />Authorizes any local government that is required to create a public works plan to apply to the office of <br />smart growth in the department oflocal affairs for financial assistance in creating such plan. States that the office <br />may award planning grants to any local government that applies on the basis of need as determined by the office. <br />Defines terms. Makes conforming amendments. <br /> <br />. <br /> <br />Be it enacted by the General Assembly of the State of Colorado: <br /> <br />SECTION 10 Title 29, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW <br /> <br />ARTICLE to read: <br /> <br />ARTICLE 20.5 <br /> <br />29-20.5-101. <br /> <br />Public Works Planning , <br />Legislative declaration. (1) THE GENERAL ASSEMBLY HEREBY FINDS AND DECLARES THAT. <br /> <br />CITIZEN'S DECISION TO LIVE IN A CERTAIN COMMUNITY IS ALSO THAT CITIZEN'S INVESlMENT IN THE COMMUNITY. DUE <br /> <br />TO THE IMP ACTS OF GROWTH, THE STRAIN ON GOVERNMENTAL RESOURCES, INCREASED DEMAND FOR GOVERNMENTAL <br /> <br />SERVICES, AND THE UNPREDICTABLE ECONOMIC AND POLITICAL LANDSCAPE OF LOCAL COMMUNITIES, IT MAY BE <br /> <br />DIFFICULT FOR CITIZENS TO ASCERTAIN THE SHORT- AND LONG-TERM PROGRESS OF THE INVESlMENTS IN THEIR <br /> <br />COMMUNITIES. HOWEVER, LOCAL GOVERNMENTS ARE IN THE;POSITION TO ASSIST CITIZENS IN MEASURING THE PROGRESS <br /> <br />AND SUCCESS OF SUCH INVESlMENTS BY SUCCESSFULLY PROVIDING GOVERNMENTAL SERVICES THAT SATISFY THE <br /> <br />CURRENT NEEDS OF THE COMMUNITY AND BY DEMONSTRATING THE FORESIGHT TO PLAN FOR THE COMMUNITY'S NEEDS <br /> <br />IN THE FUTURE. <br /> <br />(2) THE GENERAL ASSEMBLY FURTHER FINDS AND DECLARES THAT PUBLIC WORKS PLANNING IS A <br /> <br />GROWTH-NEUTRAL MECHANISM THAT ALLOWS LOCAL GOVERNMENTS TO PLAN FOR AND ADEQUATELY FROVIDE PUBLIC <br />WORKS AND THEREBY ACCOMPLISHES EFFICIENT GOVERNMENT PLANNING, ENSURES THE EFFICIENT EXPENDITURE OF <br /> <br />GOVERNMENT FUNDS, MAINTAINS THE VALUE OF THE INVESlMENT THAT CITIZENS MAKE IN THEIR COMMUNITIES, ANe. <br />PROMOTES TIIE PUBLIC HEALTH, WELFARE, AND SAFETY. <br /> <br />-2- <br /> <br />HB <br />
