Steam and Lake Protection Section - New Appropriations - Resolution of Contested <br />Cases <br />Track 1, Start/Stop: 3:39:22.3:42:32 <br /> <br />Action: <br /> <br />Action: <br /> <br />Big Blue Creek <br />A motion was made by Greg Hoskin to accept staff recommendation to: 1. <br />Determine, pursuant to section 37.92.102(3), CRS, and based upon the <br />recommendation of the BLM, a review of the data and other information <br />presented by the staff, in the memo and orally, all Public Comment and staff's <br />recommendation for instream flow and natural lake level appropriations on the <br />streams and lakes identified; that: a. A natural environment does exist; b. <br />Water is available for appropriation; c. The natural environment will be <br />preserved to a reasonable degree by the water available for the recommended <br />appropriation; d. There is a natural environment that can be preserved to a <br />reasonable degree with the recommended water right, if granted; and e. Such <br />natural environment can exist without material injury to water rights. 2. Date <br />of Appropriation. pursuant to Rule 5.23, staff recommends the Board select <br />January 23, 2002, as the date of appropriation for the Big Blue Creek. 3. <br />Request the Attorney General's Office to file the necessary water rights <br />applications. Stream and Lake Protection Section - Water Acquisitions Program - Donation of <br />Water Rights - South Fork Poudre River and Poudre River <br />Track 1, Start/Stop: 3:42:32.3:47:33 <br />Action: A motion was made by Eric Wilkinson to accept staff recommendation that <br />the Board formally accept the donation from the City of Fort Collins conveyed <br />in the Rockwell Ranch water rights and direct staff to notify the Division <br />Engineer of the Board's intent to relinquish the water rights to the stream. The <br />Director of CWCB will send a letter to the forest service regarding the land <br />exchange. The motion was seconded by Kent Holsinger, on behalf of Greg <br />Walcher, and approved 9.0. <br /> <br />24.
