Determine, pursuant to section 37.92.102(3), CRS, and based upon the recommendation of the BLM, a review of the data and other information presented by the staff, in the memo and orally, all Public Comment and staff's recommendation for instream flow and natural lake level appropriations on the streams and lakes identified; that: a. A natural environment does exist; b. Water is available for appropriation; c. The natural environment will be preserved to a reasonable degree by the water available for the recommended appropriation; d. There is a natural environment that can be preserved to a reasonable degree with the recommended water right, if granted; and e. Such natural environment can exist without material injury to water rights. 2. Date of Appropriation. pursuant to Rule 5.23, staff recommends the Board select January 23, 2002, as the date of appropriation for the Big Blue Creek. 3. Request the Attorney General's Office to file the necessary water rights applications. The motion was seconded by Keith Catlin and approved 9.0. Stream and Lake Protection Section - Water Acquisitions Program - Donation of Water Rights - South Fork Poudre River and Poudre River Track 1, Start/Stop: 3:42:32.3:47:33 Action: A motion was made by Eric Wilkinson to accept staff recommendation that the Board formally accept the donation from the City of Fort Collins conveyed in the Rockwell Ranch water rights and direct staff to notify the Division Engineer of the Board's intent to relinquish the water rights to the stream. The Director of CWCB will send a letter to the forest service regarding the land exchange. The motion was seconded by Kent Holsinger, on behalf of Greg Walcher, and approved 9.0. 24.
