<br />I <br /> <br />Representative Spano: Well, the point of interest as far as I am con- <br />cerned is what if this is designated as a wild river area, what advantage <br />will the public accrue that they will not accrue under the present state <br />right now? What is the benefit that the public will have? Why des- <br />ignate it as a wild river area if nothing more can Qe accomplished by <br />taking away some of the land from private landowners? Will they qe able <br />to enjoy the area? Mr. Sparks talked about exploita~ion of the area. <br />What is,really meant by exploitation? Can the public really benefit <br />without designating this as a wild river area? <br /> <br />Mr. Sparks: Parts of the river are in private owQership which means <br />that the public can be excluded from the area at the present time. Under <br />our law, if the landowner: owns the channel 0 f the "river' he, can prevent <br />people from traversing the river. The primary purpose of the wild <br />rivers act is to make the lan~ forever available to the public and to <br />prohibit further development in the area. <br /> <br />Mr. Kuiper has already brought up a point. Undoubtedly, somebody will <br />want to put a dam in that area in the future. This is what the 'act is <br />designed to prevent. The Congress has determined that we should not <br />permit the endless exploitation of the land of the United States. <br /> <br />Representative Spano: One question about trespassing on the river. If <br />a man owns the river bottom, would this prohibit a raft traversing the <br />river over his property? <br /> <br />Mr. Sparks: Yes. <br /> <br />Representative Spano: In Colorado, but that is not true in all states. <br /> <br />Mr. Sparks: I don't know about other states. <br /> <br />Mr. Stapleton: The next question.
