Furthermore. the Board was <br />disappointed over the fact that the United States had applied <br />for minimum stream flows on Castle Creek without first seeking <br />the Board's cooperation and assistance. <br /> <br />FOllowing his discussion of this issue along the lines of <br />the foregoing facts. Mr. McDonald recommended that this item. <br />as well as item 3(4) above (Sierra Club v. Block). be <br />considered in consultation with the Attorney General in an <br />executive session. <br /> <br />Mr. Paddock cautioned the Board that only intervention in <br />the litigation. Sierra Club v. Block. not Senator Armstrong's <br />wilderness bill. could be addressed in the executive session. <br />With this restriction. Attorney General Woodard concurred with <br />Mr. McDonald's recommendation to consider the two items in an <br />executive session. Thereupon. Mr. Vandemoer moved. seconded by <br />Mr. Smith. that the general session be recessed and that the <br />Board proceed to executive session. Motion approved by <br />unanimous vote of 8 to O. The executive session convened at <br />3:10 p.m. and recessed at 5:30 p.m. <br /> <br />Friday Session (September 14. 1984) <br /> <br />The Board reconvened in executive session at 7:00 a.m. and <br />. recessed at 9:00 a.m. <br /> <br />Chairman Johnston called the Friday pUblic session to order <br />at 9:20 a.m. <br /> <br />Mr. McDonald reported publicly at the opening of the Friday <br />session on the actions taken by the Board during the two <br />executive sessions as follows: <br /> <br />1. Sierra Club v. Block <br /> <br />Mr. Robbins moved. seconded by Mr. Getches. that the Board <br />concludes that it is not appropriate to intervene at this <br />time. Motion approved unanimously. The Board delegated to Mr. <br />McDonald. in consultation with the Attorney General. the <br />authority to petition to intervene as a party defendant if he <br />deemed that necessary prior to the next Board meeting. <br /> <br />2. No Board action taken on reserved water rights <br />litigation <br /> <br />3.
