Mr. McDonald reviewed the" histoi::y" of <br />this litigation. pointing out that the suit by the Sierr~ Club <br />alleged that the United"States has. federal reserved water <br />rights in the 24 designated federal wildernesr'areas in <br />Colorado and that the Secretary of Agriculture acted . <br />arbitrarily in not perfectin~ those rightsiin proceedings <br />pending before state courts. Mr. McDonald also discussed the <br />1984 Wilderness Bill pending in Congress and Senator <br />Armstrong's position on the Bill. which position would make <br />clear that the federal government. would receive no new water <br />rights when the wilderness areas are finally create~ <br /> <br />") , I J <br /> <br />Mr. Bill Paddock reviewed the July memorandum opinion by <br />Judge Kane. U.S; Distri~t Court. for Colorado. in this' case. In <br />his opinion. Judge Kane dismissed the State Engineer but found <br />that the court does have jurisdiction over the Secretary of <br />Agriculture. <br /> <br />Considerable discussion and comment by members of the <br />audience followed.
