FOllowing the above presentations. members of the audience
and Board members expressed concern over the impact of these
cases on Colorado water rights holders if unfavorable decisions
were handed down. Members. Robbins and Woodard. emphasized the
fact that funds being appropriated were not sufficient ,to, ,
expedite the reserved water rights litigation cases in a<1timely

In his discussion. Mr. McDonald reviewed the" histoi::y" of
this litigation. pointing out that the suit by the Sierr~ Club
alleged that the United"States has. federal reserved water
rights in the 24 designated federal wildernesr'areas in
Colorado and that the Secretary of Agriculture acted .
arbitrarily in not perfectin~ those rightsiin proceedings
pending before state courts. Mr. McDonald also discussed the
1984 Wilderness Bill pending in Congress and Senator
Armstrong's position on the Bill. which position would make
clear that the federal government. would receive no new water
rights when the wilderness areas are finally create~

Mr. Bill Paddock reviewed the July memorandum opinion by
Judge Kane. U.S; Distri~t Court. for Colorado. in this' case. In
his opinion. Judge Kane dismissed the State Engineer but found
that the court does have jurisdiction over the Secretary of
Agriculture.

Considerable discussion and comment by members of the
audience followed. Mr. Gregg Hobbs. attorney for the Nor,thern
Colorado Water Conservancy District. and Ann Vickery.
representing the Colorado Mountain Club. spoke bn this issue.
