<br />1058 <br /> <br />C <br />o <br />P <br />y <br /> <br />CITY OF ENGLEWOOD <br /> <br />Englewood, Colorado <br /> <br />July 14, 1958 <br /> <br />Colorado Water Conservation Board <br />State Office Building <br />Denver, Colorado <br /> <br />Gentlemen: <br /> <br />I <br /> <br />It has come to the attention of the City Administration of <br />the City of Englewood, Colorado, that the Water Conservation Board <br />has on its Agenda to be discussed July 18, 1958, at its meeting in <br />Durango, Colorado, the subject of use of Cherry Creek Dam to estab- <br />lish public recreation facilities. <br /> <br />Recreational use, it is presumed, would necessitate in main- <br />taining, insofar as possible, of a steady water level behind the <br />dam. It would appear that the gauge height would have to come <br />from Cherry Creek flows, thus depriving water users downstream on <br />Cherry Creek and taking water from users on the South Platte in <br />Water District No. 2 which has heretofore been available to them <br />under their respective priorities. There are no water rights de- <br />creed to Cherry Creek Reservoir, and the structure was designed <br />as a dry reservoir for flood control purposes, with operating <br />principles providing for release of water belonging to existing <br />appropriations downstream. <br /> <br />The City of Englewood obtains its municipal water supply <br />from the South Platte River in District No. 8 above Water District <br />No.2. Without a detailed study, it would appear that any taking <br />of water from users in District No. 2 would perhaps create injury <br />to the domestic water supply of the City by increasing the call <br />upon the river by those users,both as to quantity and time. Ad- <br />verse affect could thus occur upon junior priorities belonging <br />to the City and should this situation arise during a peak demand <br />period, the affect would be noticeable indeed. <br /> <br />The City does not wish to express opposition to the estab- <br />lishment of the proposed recreation facilities, as they would <br />most certainly be beneficial to the inhabitants of this community. I <br />However, it is respectfully and sincerely requested that the State <br />Water Conservation Board, as representative of the people of <br />the State, withhold approval of the proposal until after complete- <br />ly adequate engineering studies have been made to determine ad- <br />verse affects which might occur and methods of elimination of <br />the same. If injury be discovered which cannot be obviated, then <br />the project should not be approved by the Board because of injury <br />to persons and municipalities in the exercise of their vested <br />water rights. <br /> <br />Very truly yours, <br /> <br />Eel Scott, Mayor <br />City of Englewood <br />
