A fee structure was established in 1996,
but at the March 200S Board meeting staff was then requested by the Board to update and revise the 1996 fee
s1ructure for the Chatfield Downstream Channel Improvement Project. A revised fee structure was approved by the
Board at the May 200S meeting.

Staff is now requesting additional revisions to the fee structure based on lessons learned from more recent actual
easement requests, and the realization that additional flexibility is needed to allow the Staff and Board to COIlSider
fee options on a case-by-case basis.

Dlseussion
The CWCB staff originally consulted a number of entities regarding fees for Real Estate Easements, which led to
the fee structure approved by the Board in May 2OOS. The essential elements of that fee structure are not being
proposed for modification in this current request. However, staff proposes several minor revisions to provide more
flexibility to the Staff and Board in determining appropriate fees for individual easement requests. Attachment A
contains the May 2005 approved fee structure with the proposed modifications in bold color text

To better assist in the adminislration of Board duties and responsibilities for the Chatfield Downstream Channel
Improvement Project, staff reconnnends that the Board review and approve the proposed modifications to the
easement fee structure.

Reeommendation
Staff recommends that the Board approve the proposed revisions to the Chatfield Downstream Channel
Improvement Project Easement Fee Structure as presented in Attachment A.

.

Flood Protection.
