COlorado 80203 <br /> <br />January 18. 1973 <br /> <br />I <br /> <br />~ E S 0 ~ UTI 0 N <br /> <br />A RESOLUTION AUTHORIZING THE PURCHASE OR CONDEMNATION OF CERTAIN LANDS <br />ALONG THE SOUTH PLATTE RIVER BELOW THE CHATFIELD DAM. <br /> <br />WHEREAS. the Congress of the United States has..-a:uth6b:zed by <br />Public Law 516. 81st Congress (Flood Control Act of 1950f. the con..;:.... <br />struction of flood protection along the South Platte River between <br />Chatfield Dam and Denver. Colorado. as one of the projects for flood <br />control in the South Platte River basin: and <br /> <br />,- <br />-~ - <br />WHEREAS. the District Engineer. U. S. Army Engineer District. <br />Omaha. Nebraska. has formulated a plan of improvement Which has been <br />explained and discussed with local interests. and consists"'of-"levees <br />and channel alterations along the South Platte River between Chatfield <br />Dam and Denver. Colorado: and <br /> <br />WHEREAS. the Colorado Water Conservation Board recognizes <br />that the plan will create substantial benefits through the alleviation <br />of flooding and flood damages: and <br /> <br />WHEREAS. pursuant to existing federal law. the State of <br />Colorado must procure the necessary lands. easements and rights-of-way <br />for the construction of the channel improvement between the Chatfield <br />Dam and the City of Denver: and <br /> <br />WHEREAS. pursuant to 149-1-11(11). Colorado Revised Statutes <br />1963. as amended. the Colorado Water Conservation Board is authorized <br />to purchase or acquire by eminent domain any real property or interest I <br />therein with respect to any project specifically authorized by the . <br />United States Congress for the prevention or control of floods: and <br /> <br />WHEREAS. during the years 1969 and 1970. the Colorado Water <br />Conservation Board caused an appraisal to be made of the lands required <br />for channel improvement as a part of the Chatfield Flood Control Project. <br />which appraisal was made by the Frederick R.
