Hr. Stapleton: Hr. Burr r.\oved. It has been moved and seconded. Any
discussion? All those in favor will signify by saying "aye" - opposed,
"no." The resolution is unanimously carried. (See Appendix B).

i'lr. Patenode, we appreciate your presentation. I notice that Bear
Valley Shopping Center is in the flood plain.

The next item - we are going back to item number 4.

ilr. Stapleton: Yes, sir.

l'lr. Burr: I \-Tould lil~e to say that I might have misunderstood that.

llr. Stapleton: Hell, Clarence, ,the motion as I understood i.t was that
'we were just merely to review it again and bring it back to the board
for final approval.

ilr. Burr: I can hear you now, but I couldn't hear you awhile ago.

ilr. Stapleton: I had my bacl~ to you. I knew you were going to vote
no. I turned my back to you.

All right, we will indicate a change in record that ilr. Burr is going
along with us for one more meeting.

Let's go into agenda item number 4. This relates primarily to the
suit by the federal government that many of the la'~ers in this room
have been working on. It is another great haven for la'~ers. Ne ,.,ill
have Larry bring us up to date quicl~ly on it, and then we will have
some discussion. Larry.

i,lr. Sparks: There is no\'1 pending in the state and federal courts
various claims by the Uni'ced States claiming waters origina.ting in
Colorado. i.~ny of these federal claims appear to seriously jeopardize
the existing system of "Tater rights in Colorado. One of 'the problems
is that the federal government is trying to antedate its claims back
to the establishment of a national park, national monument, Indian
reservation, or whatever it may be. The t\'10 most serious objections
