<br />Mr. Stapleton: Since we are not in complete agreement on it, I would <br />like to give as much time for discussion as we need. Before we get to <br />some members of the audience, l~. Maynes is going to be v~. Kroeger's <br />proxy this afternoon. Hr. Maynes from Durango, is that right? A <br />skier from around there. <br /> <br />I <br /> <br />~~. Mavnes: Right. <br /> <br />1~. Stapleton: I am going to ask that the members of the board if <br />they have any comments or suggestions about the proposed amendment <br />that Mr. Sparks has proposed, or if you have any comments on the <br />approach that ~~. Saunders had, that will be fine. But unfortunately <br />none of us but Mr. Sparks has seen that in writing. So I will ask <br />for any comments any members of the board may have. <br /> <br />I guess at lunch you may have taken a definite position you hadn't <br />told me about, but let's get to some members of the audience. I have <br />a feeling some of the lawyers who were at the meeting are still at <br />lunch. Well, I am not going to pass it that easily, I am going to <br />turn to another item on the agenda for a minute, because I am going <br />to see if we can't get some discussion out of them because it is <br />important. ~1hile we are waiting we will asle if you don't mind, to <br />turn to agenda item number 5. We ask our distinguished attorney to <br />tell us about the Sunshine Law, particularly as it affects this board <br />in terms of who can speak and whether they are allowed to if they <br />are not registered lobbyists. We will call 0n ~rr. Mose8 to analyze <br />that for us. <br /> <br />~~. Moses: The board members have in their packets my opinion and I <br />am not going to read it as it is too long and the constitutional <br />opinion, a copy of the bill and a copy of the Attorney General's <br />op~n~on. I think you will be pleasad to know that the way this board <br />has conducted its business for the last twenty years has been entirely <br />in accord with the philosophy and I think the strict reading of the <br />bill. I see no reason for the board to change any of its policies or <br />procedures. You have sent out notices of the meetings to a wide list <br />of people and have always made the notice and the agenda items avail- I <br />able to anyone who has submitted his name to the board and wanted to <br />be put on the mailing list. That is one of the requirements, that <br />there be a..le notice of the meetinga_ the "genda, indicating what i, - <br />going to be discussed, that the meetings be opcn to the public, to <br />not hold executive sessions and that has bc~n the policy of the board. <br />There are certain things which do not have to be discussed in public, <br />such as pending lawsuits. As one court opinion said, it is obvious <br /> <br />-33- <br />
