<br />degree by the water available for the recommended <br />appropriations; <br />(d) There is a natural environment that can be preserved to a <br />reasonable degree with the recommended water rights, if <br />granted; and <br />(e) Such natural environment can exist without material injury <br />to water rights. <br /> <br />(2) Appropriate, based on these determinations, the recommended instream <br />flow water rights on the stream listed in the attached notices, said <br />appropriations being for such waters a have been determined to b required <br />for minimum stream flows to preserve the natural environment to a <br />reasonable degree. The date of appropriation shall be changed to July 13, <br />1998. <br /> <br />(3) Request the Attorney General's Office to file the necessary water rights <br />applications. <br />The motion was seconded by Patricia Wells and approved unanimously (8-0). <br /> <br />7b. Instream Flow Program - New Appropriations - Phase 111- Board Action - Division 4 <br /> <br />Tape 1, Start/Stop: 4607 -4725 <br />Action: A motion was made by Patricia Wells that the Board accept the staff <br />recommendation (see 7a language above) on these 2 stream segments The <br />motion was seconded by William Brown and approved unanimously (8-0). <br /> <br />7c. Instream Flow Program - New Appropriations - Phase 111- Board Action - Division 2 <br />Tape 1, Start/Stop: 4725 - 6235 <br />Tape 2, Start/Stop: 0001 - 2133 <br />Action There was a lengthy discussion of the Tennessee Creek and Fourmile Creek <br />items, and several interested parties spoke. Alan Hamel recused himself <br />from the Tennessee Creek discussion. A motion was made by Eric Kuhn that <br />these items be tabled until a special meeting is held on December 9th at 2:30 <br />p.rn. in Room 318 of the Centennial Building to discuss these issues. The <br />motion was seconded by Patricia Wells and approved unanimously (8-0). <br /> <br />8a. Instream Flow Program -Informational Items - Summary of Resolved Cases <br />Tape 2, Start/Stop: 0000 - 0000 <br />Action: This was an informational item; no presentation made. <br /> <br />8b.
