Copies are available upon request from the CWCB for a fee of25 cents per <br />page. <br /> <br />ImARING PROCEDURE <br /> <br />The CWCB will not apply the rules of evidence or civil procedure. No member of the public or <br />CWCB Staff shall have the right to cross examine any person speaking at the hearing. CWCB <br />members may ask questions of any person appearing before them. At the end of all public comment, <br />the CWCB may allow members of the public to ask questions of staff or the CWCB. <br /> <br />The chair of the CWCB may stop any Scheduled Oral Presentation or General Public Comment <br />ifthe person speaking has exceeded his/her allotted time. No exhibits, maps, demonstrative exhibits or <br />physical evidence may be presented in the oral summary unless such material was attached to the <br />participant's written comments. Once written comments are submitted to the CWCB, the material <br />becomes part of the Administrative Record and the property of the CWCB and will not be returned to <br />the person offering the material. <br /> <br />Subject to section 24-4-103, C.R.S., the Board may modify the proposed revised Rules prior to <br />promulgating fmal revised Rules. <br /> <br />DESCRIPTION OF TIm SURTECTS AND ISSUES INVOLWD <br /> <br />e <br /> <br />Under the proposed amendments to the Rules, current Rule 6g. will be deleted in its entirety and <br />replaced with the following: <br /> <br />6g. Temnorary Acquisitions. The Board may acquire water for instream flow use <br />for a period Dot to exceed 120 days in any basin or county in which the governor has <br />declared a drought emergency or in which any other emergency is declared, in <br />accordance with the procedures set forth in section 37-83-105, C.R.S. (2003). <br /> <br />Rule 6i. will be revised to read as follows, with additions highlighted: <br /> <br />6i. Public Input on Proposed Acquisitions. The Board shall follow the public <br />review process in Rules II a. - II c. when acquiring water, water rights or interests <br />in water, except as provided in Rule 6g. above and except as provided below. <br /> <br />e <br /> <br />(I) Prior to Board consideration of any proposed acquisition, Staff shall <br />mail notice of the proposed acquisition to all persons on the ISF <br />Subscription Mailing List for the relevant water division, and shall <br />provide Proper Notice. Such notice shall include: <br /> <br />(a) the case number adjudicating the water right proposed to be <br />acquired, and the appropriation date, adjudication date, priority, and <br />flow amount of the water right proposed to be acquired; <br />(b) the location of the stream reach or lake that is the subject of the <br />proposal, including, when available, the specific length of stream <br />reach to benefit from the proposed acquisition; <br />
