<br />NOTICE OF PUBLIC RULEMAKING HEARING BEFORE THE <br />COLORADO WATER CONSERVATION BOARD <br /> <br />SUB.TECT <br /> <br />This is a notice of a public rulemaking hearing before the Colorado Water Conservation Board <br />(CWCB) for consideration of amendments to the Rules Concerning the Colorado Instream Flow and <br />Natural Lake Level Program, 2 CCR 408-2. The amendments (I) implement H.B. 03-1320, which <br />authorizes the CWCB to temporarily acquire water rights for instream flow use under certain <br />conditions and in accordance with specified procedures; and (2) revise Rule 6i., which establishes a <br />procedure for public input into the CWCB's acquisitions of water, water rights and interests in water. <br />The proposed amendments are set forth below. A redlined version of the proposed rules showing <br />changes to the current rules is posted on the CWCB's website at http://cwcb.state.co.us/. A hard copy <br />is available upon request to the CWCB staff(1313 Sherman Street, Room 723, Denver, CO 80203; <br />(303) 866-3534). The CWCB may change the proposed amendments set forth herein prior to or at the <br />rulemaking hearing. Oral <br />presentations of the information contained in the written comments will not be necessary; however, the <br />CWCB will allow brief oral summaries ofthe public written comments to be made, to the extent time <br />allows, as described below. Although the CWCB strongly encourages all interested persons to submit <br />their comments in writing, a short period oftime at the end of the rulemaking hearing (a total of 30 <br />minutes or less) will be reserved for oral comments by those persons unable to provide the CWCB <br />with written comments. <br /> <br />Written Comment Deadline <br /> <br />e <br /> <br />Twenty copies of all public written comments must be delivered to the CWCB office at 1313 <br />Sherman Street, Room #723, Denver, CO 80203 by the close of business (5:00 p.m.) on April 26, <br />2004. The CWCB will accept and consider late written comments and day-of-hearing written <br />comments, but any person who fails to deliver written comments by the April 26, 2004 deadline will <br />not be entitled to make a Scheduled Oral Presentation, as described below.
