The City submits the request at this time in order to comply with the
deadline set forth in Rule 12 of the CWCB's Recreational In-Channel Diversion Rules, 2 CCR
408-3 ("Rules").

Pursuant to Rule 13, the City's request will trigger the appointment ofa hearing
coordinator that will establish various deadlines and set a hearing date. However, the City and the
CWCB are filing ajoint motion in this case to extend the CWCB's deadline for making its
reconunendation to the water court until 90 days after the Supreme Court issues a ruling in the
Golden kayak case. Accordingly, assuming tho motion for extension is granted, the City asks that
the hearing coordinator defer establishing deadlines and a hearing date until after the Supreme
Court issues its Golden opinion.

Please have your counsel contact me if there are any questions or concerns.

'UJ

David Hayes

DSH:cav
Enclosure
cc: Mr. Dale Rademacher
Susan J.
