McDONALD: If it's a matter of a senior

conditional simply going final pursuant to the terms of the

original conditional decree.

MR. GETZ: Pursuant to terms of the original, but

say they decide to change the point of diversion of the
original decree.

MR. McDONALD: If they want to change --

MR. GETZ: Then the State would step in as a
litigant in the matter.

MR. McDONALD: Well, that's at the choice of the

Board. Let's put it this way. We have the legal right to

be there if we choose to be there, but it's a policy decision

whether or not the Board wants to direct us to get involved

in asserting a position.
MR. GETZ: I think this is one of the big concerns

of these people, what the Board will decide.

MR. VANDEMOER: Floyd, what the Board has tried to

do again, you can't be a mind reader and I never have been

on minimum stream flows, but what the Board has tried to do,

back to what Dave said, is that the Board has tried to

stipulate and think and help the fellows on the farms, on

the ranches, think of all those things that are going to

happen at least in your future and then we adjust accordingly

to that. I know we've done that to the San Louis Valley
and we've done that on other streams.
