They're just saying, "You can't build the facility," and

if you can't store the water, why, there's no sense to

build the reservoir.

MR. JACKSON: But they allege consumptive use
increase. Doesn't-that almost make it necessary for them to

have some water rights to argue the point?

MR. SAYRE: I don't think so. The habitat --
critical habitat --

MR. ROBBINS: I'd like to ask a couple of

questions if I could just for the purpose of clarification.
Maybe Mr. Montgomery or the director could field them. I'd

like to know what the compact impact is. I think that's

one of the things the Board needs to take into account in

this consideration. What affect does it have on the State

compact?

Secondly, what affect does it have to other rivers or

compacts, if any, and thirdly, what would be some possible

effects of the State of Colorado entering as a State in the

litigation? What might we expect?
I think we should air those so that we can present

them to the Governor if we're going to ask him to take this

step.
