United States Department of the Interior www.co.blm.gov APR 2 8 2005 Mr. Rod Kuharich, Director Colorado Water Conservation Board 13 13 Sherman Street, Seventh Floor Denver, Colorado 80203 Dear Mr. Kuharich: The purpose of this letter is to request that the Colorado Water Conservation Board delay its final instream now appropriations on the following two stream segments: Escalante Creek - Case Numbcr 05/04/A-016 Escalante Creek - Case Number 05/04/A-017 . The Bureau of Land Management (BLM) was the recommending agency for tilese appropriations. However, since the time of thc fonnal recommendations, BLM has learned that a private landowner along these segments has questions regarding how the proposed appropriations will work with BLM's land use planning process for the Escalante Creek - Dominguez Creek area. BLM requests additional time to answer the questions and concerns of the landowner before a final appropriation is made. These recommendations were not formally contested by the March 31 deadline, and under the instream flow rules, the board could precede with tile final appropriation as early as its late May meeting. However, BLM requests that the final appropriation decision for these two segments be delayed until the late September board meeting, when the board will act upon contested stream segments.
