<br />Motion: To approve the recommended revisions to the <br />~ appropriations as set forth in the attached Appendix F. <br /> <br />Moved by Mr. Robbins. <br /> <br />Seconded by Mr. Kroeger. <br /> <br />Approved: Yes. <br /> <br />IOe. POlicy Concerning Injury to instream flow rights. <br /> <br />Gene Jencsok briefly outlined the problem and the alternate <br />approaches as described in memo to Board. Considerable Board <br />discussion followed. <br /> <br />Mr. Robbins did not believe that Board could enforce <br />stipulation after subdivision has been in operation and developer <br />has gotten out. <br /> <br />The general consensus was that option a was not acceptable <br />and option c would be difficult or impossible to enforce. <br /> <br />Motion was made for the staff to suggest criteria and <br />guidelines and procedures to implement option for future <br />consideration by the Board. <br /> <br />Moved by: Mr. Jackson <br /> <br />. <br /> <br />Seconded by: Mr. Getches <br /> <br />Approved: unanimously <br /> <br />lOco Ratify proposed stipulation <br /> <br />Mr. Jencsok briefly reviewed case #4-83CWI16 in light of the <br />previous discussion and recommended that the previously filed <br />statement of opposition be withdrawn. At first, Mr. Lochhead <br />moved and Mr. Jackson seconded a motion to maintain the statement <br />of opposition. However, upon discussion of the small magnitude <br />of injury and the fact that in past cases the Board has taken <br />similar action the original motion was withdrawn and a second <br />motion to withdraw statement of opposition was made, with the <br />condition that this would not set a precedent. <br /> <br />Moved by: Mr. Lochhead <br /> <br />Seconded by: Mr. Getches <br /> <br />Approved: Unanimously <br /> <br />Case #2-82CW216 <br /> <br />. <br /> <br />-7- <br />
