<br />Agenda Item 10 - Instream Flow Program <br /> <br />This item consisted of 5 parts which are summarized as <br />follows: (See Appendix F attached.) <br /> <br />. <br /> <br />lOa. Preliminary Notice - Water Division 1 <br /> <br />Gene Jencsok presented a brief discussion and requested that <br />the North Fork South Platte River from the confluence with <br />Buffalo Creek to the confluence with the South Platte River <br />(second entry, pg. 2, of Preliminary Notice) be deleted. Mr. <br />Robbins explained that this segment of stream was involved in the <br />Round Table discussion to seek a solution to Denver's future <br />water needs and storage in that area of the South Platte River. <br />He further stated that he hoped that this segment could be <br />reconsidered at a later date. <br /> <br />No specific Board action was required. <br /> <br />l~. <br /> <br />Ratify Statement of Opposition <br /> <br />Case #2-83CW088 Town of Buena Vista <br /> <br />Gene Jencsok briefly explained the case. Motion to ratify <br />was made by Mr. Jackson, seconded by Mr. Kroeger and approved <br />unanimously . <br /> <br />lOco Discussed after 10e discussion. <br /> <br />10d. Approve Revisions to Appropriations <br /> <br />. <br /> <br />Gene Jencsok presented proposed revisions to appropriations <br />made in WD-2 in 1982. <br /> <br />Mr. Jencsok recommended approval and submission to Upper <br />Arkansas Valley WCD for its approval and request to withdraw <br />their statement of opposition. <br /> <br />Comments by the Board, Mr. McDonald responded that this a <br />unilateral recommendation of the staff. Mr. Robbins commented <br />that the Board should make these revisions in any regard. Mr. <br />McDonald concurred. Comments by the staff that some streams were <br />withdrawn from application as DOW was asking for too much water. <br />Mr. Robbins expressed appreciation and stated that the Board <br />needs to obtain technically justified flows. However, it must be <br />understood the DOW's job is to get as much water as possible. <br />The CWCB's role is to balance DOW's recomendations with that <br />which is necessary. Mr. McDonald stated that many improvements <br />have been made in procedures over those of several years ago. <br />There is reconsideration of ~revious decrees through conflicts <br />found in the resume reviews. <br /> <br />. <br /> <br />-6- <br />
