Arkansas River Compact Issues <br /> <br />The minutes for the July 7, 1983 Board meeting reported <br />that the State of Kansas contends that the operation of <br />Trinidad and Pueblo Reservoirs was not in conformance <br />with the Compact. In his remarks, Mr. McDonald stated that <br />the State of Kansas has retained a Consulting Engineering <br />firm to gather data for use in possible litigation to be <br />filed by the State of Kansas to suport its claim. Much of <br />the data has been obtained from information in the Board's <br />files. <br /> <br />5. Mr. McDonald summarized actions taken by the General <br />Assembly in a special session convened in October to seek <br />solutions to the State's fiscal situation. He stated that <br />in the final passage of the negative supplemental <br />appropriation bill the General Assembly approved the use of <br />construction fund monies, up to the point of matching input <br />by Board staff members, to offset reductions in general fund <br />monies recommended by the Joint Budget Committee. <br /> <br />6. Colorado Water Resources and Power Development Authority <br />Contracts <br /> <br />. <br /> <br />Mr. McDonald reported that in its recent meeting the <br />Authority Board members approved a contract under which the <br />Authority would fund the St. Vrain Basin Feasibility Study. <br />In the same meeting, the Authority Board declined to fund <br />additional feasibility studies on the Grand Mesa Project. <br /> <br />Agenda Item 5 - Attorney General's Report <br /> <br />Chairman Vandemoer called on Bill Paddock, First Attorney <br />General to present this report in the absence of Attorney General <br />Duane Woodard. <br /> <br />Mr. Paddock reported on several legal issues including the <br />following: <br /> <br />1. Riverside versus Andrews litigation <br /> <br />2. Vermejo Case <br /> <br />3. Supreme Court Case - People versus Amity Canal Company <br /> <br />4. Federal and Indian Reserved Rights Claims <br /> <br />5. Dinosaur National Monument - Federal reserved water <br />right claims <br /> <br />6. U.S. amended water right filing for oil shale <br /> <br />. <br /> <br />-3- <br />
