<br />2. The CDOT project design will completely cut off CWCB access to the South Platte Channel <br />Project lands and all project features; . <br /> <br />3. The CDOT Project design has terminated the CWCB and South Suburban Park and Recreation <br />District bike and trail system for the right overbank and floodplain areas; <br /> <br />4. The Board cannot access and maintain an existing stormwater outfall system; <br /> <br />5. Present CDOT roadway design does not provide any considerations for the CWCB river and <br />floodplain needs; <br /> <br />6. There are concerns regarding the present roadway alignment; <br /> <br />7. There may be opportunities to re-design the intersection to accommodate the CDOT and <br />CWCB access requirements; and <br /> <br />8. The issuance ofthis easement request will be in violation of the contract provisions of the US <br />Army Corps of Engineers - Colorado Water Conservation Board South Platte Channel Project <br />agreement. <br /> <br />RECOMMENDATION <br /> <br />Following a review by the AG's Office and CWCB staff for Agenda 4.1. request, a <br />recommendation is as follows: <br /> <br />. <br /> <br />Grant a conditional approval of the Colorado Department of Transportation (CDOT) easement <br />request and authorization to the CWCB Acting Director to commence negotiations with CDOT for <br />securing an easement agreement that will fully address the staff's November 20, 1998 fmding and <br />the South Platte Channel Improvement property requirements with the US Army Corps of <br />Engineers. Grant the authorization to the staff to prepare the necessary easement agreement and <br />authorize the Acting Director to execute the easement agreement. <br /> <br />2 <br /> <br />. <br />
