<br />b <br />'~72 <br /> <br />At the meeting of the Colorado Water Board after the April <br />hearing before the special master I indicated, and I <br />think the Board agreed with me, and Governor Johnson, I <br />know, expressed himself forcibly that we should k~ep <br />our eyes on that litigation to be sure that there are no <br />issues tried in that case which would affect our rights. <br />I told the Board that if the litigation was tried with <br />the issues raised by Arizona plus two or three issues <br />raised by California, I found that our rights would not <br />be jeopardized. Since then, the action of the Supreme <br />Court eliminated us from the lawsuit.. California is <br />still trying to raise interbasin issues which do affect <br />our interests. Their most recent move in this respect <br />has been by the service of certain interrogatories or <br />questions that they submrrted to the United States to <br />be answered. <br /> <br />I <br /> <br />By these interrogatories, California again raises the question <br />of Indian claims against the entire river system. The <br />hearings begin on April 10, when there will be a pre-trial <br />conference before the-new master in San Francisco. I <br />believe that the pre-trial conference will determine the <br />course of the Arizona--California litigation and the issues <br />to be tried. So far as we are concerned, it is an important <br />conference and I will attend it as an observer. <br /> <br />It is quite important to us as to how the United States <br />answers these questions. We have had assurance from <br />the Attorney General's office, that the matter of these <br />Indian claims against the river system are not going to <br />be raised in this. However, there have been some <br />developments that have disturbed us. I am going back to <br />Washington this afternoon to consult with our congressional <br />delegation and other persons to see if we can get further <br />assurances from the Dept. of Justice that these inter-basin <br />questions (Indian claims) are not going to be raised." <br />.
