, ' Community Bulletin Page 7 Legal Update Laramie-FoxHills Case Headed for Supreme Court Trial Management Conference Held Last spring Judge Hays ruled on motions presente~ by the opposers in the Laramie-Fox Hills case (96-CW-013) that the specific statutes relied upon both by the applicant and the state nave no applicability out- side the Denver Basin, Since the proponent had relied on the appli- cation of those statutes, attorneys have lodged an appeal of this rul- ing to the State Supreme Court, and have filed an opening brief on the matter. Opposers have re- quested an extension until early January to file their answer briefs, The applicant then has a chance to file a reply brief. The Supreme Court will likely hear oral argu- ments on the materials presented, If it decides to hear onil argument, both sides will appear berore the Court, After the oral argument is complete the justices will take the matter under advisement and ren- der a decision later, It could take from six months to a year for the court to render its decision, ~1 "': , " .:..,--:>. ., ;, ~~ -1/1 ~~.-. U.S. Geological Survey Studies to Continue, Available On-line Fiscal Year 1999 began the third year that the City of Aurora has cooperated with the USGS to collect baseline data regarding water resources in the Tar- ryall basin, The USGS installed a stream gage on Tarryall Creek below Park Gulch in spring of 1997, The gage has been collecting stream flow informa- tion spring through fall. In addition to stream flow information. monthly wa- ter quality samples have also been taken, The USGS also collects water level information at 30-35 wells located around the project area in the South Park Basin, The wells were selected to provide geographic coverage and to be rep- resentative of the different aquifer systems in the Tarryall basin near the pro- posed South Park Conjunctive Use Project.
