<br />I <br /> <br />I <br /> <br />129 <br /> <br />"WHEREAS, the general welfare of the United States and of <br />the affected States requires that each Colorado River Basin <br />State make use of its equitable share of the water of the <br />Colorado River System in order that a great natural resource <br />be beneficially utilized rather than wasted. <br />"NOVi THEREFORE, BE IT RESOLVED, by the Colorado River <br />Basin States Co~mittee consisting of the States of Arizona, <br />Colorado, New Mexico, Utah and Wyoming and open to the States <br />of California and Nevada that H. J. Res. 3 and allied resolut:i,ons <br />should not be enacted by the Congress of the United States for <br />the following reasons: <br /> <br />"1. There is no justiciable controversy. <br /> <br />"2. Congressional consent to suit aids the proponents of <br />litigation by wrongfully implying that there is a justiciable <br />controversy. <br /> <br />., <br /> <br />"3. The proposed litigation imperils the Colorado River <br />Basin development essential to national welfare and national <br />defense. <br /> <br />"BE IT FURTHER RESOLVED, that the statement is approved as <br />expressing the views of this Committee and that the Chairman of <br />the Committee is directed to forvlard a copy of this Resolution. <br />with the statement to any and all Congressional Committees which <br />may give consideration to H. J. Res. 3 and allied resolutions." <br /> <br />Discussion of the matter ensued. <br /> <br />It was then moved by Mr. Dille that the opposition of <br />Colorado to the proposed California resolution, as presented to <br />the proposed California resolution, as presented to the Board <br />by the Director, Mr. Breitenstein and ~r. Tipton, and the <br />resolutio~ of the Colorado River Basin States Committee, be <br />approved and that the Director of the Colorado Water Conserva- <br />tion Board be ,authorized to take such further action on such <br />matter as he deems necessary to carry out and effectuate <br />Colorado's position. <br /> <br />The motion was seconded by 1~. Smith. On vote being taken, <br />the motion was declared unanimously adopted. <br /> <br />The Board took up discussion of the proposed Narrows Reservoir, a project <br />on the South Platte River, near Fort Morgan, Colorado, a part of the Missouri <br />Basin plan. The Director said the project's purpose was flood control, and <br />conservation and reregulation of water imported from the Colorado River Basin. <br />The N~rrows reservoir was incl~ded in the President's flood control program, but <br />its proposed location, capacity and operations are questioned by engineers of the <br />State. Hater Board and affected local interests. A further survey and investiga- <br />tion are deemed by the State and local interests as being necessary. <br />
