Evans <br />CWCB Director <br /> <br />DATE: <br /> <br />January 16,2000 <br /> <br />SUBJECT: Agenda Item 23g, January 26-27, 2000 Board Meeting- <br />Colorado River Basin Issues - 15 Mile Reach Programmatic Biological <br />Opinion - Implementation <br /> <br />Backeround <br /> <br />The Finall5-Mile Reach Programmatic Biological Opinion (PBO) was signed in <br />December 1999. Pursuant to the PBO, development and implementation of certain flow <br />related actions by the Recovery Program is required. The following is a list of, and status <br />report on, the flow related actions only that are included in the PBO and that must be <br />implemented. <br /> <br />. Protection of 581 cfs in the 15-MR from July I st through September 30th - the <br />CWCB has obtained a decree for this in case number 5-92CW286 and is exercising <br />the right. <br />. Protection of 300 cfs of accretions to the 15-MR from July I st through September <br />30th - the CWCB has obtained a decree for this in case number 5-94CW330 and is <br />exercising the right. <br />· Delivery of 5,000 AF annually from storage plus an additional 5,000 AF in 4 out of 5 <br />years via operational changes from Ruedi Reservoir in consultation with the U.S. <br />Bureau of Reclamation (USBR), U.S. Fish and Wildlife Service (USFWS) and <br />CWCB - This Agreement was required in the final EIS for the Fryingpan-Arkansas <br />Project filed August 1,1989. A contract between the 3 agencies was executed in <br />February 1990 and 10,000 AF has been delivered annually except in above average <br />water supply years like 1993 and 1995. <br />. Delivery of21,650 AF annually from the unsold regulatory capacity of Ruedi <br />Reservoir until a firm source for half can be put in place by the water users - Annual <br />agreements have been made each year since 1996. <br />. Denver Water (DW) and the Colorado River Water Conservation District <br />(CRWCD) have agreed that each will supply half of the 10,825 AF on an interim <br />
