Other <br />considerations shall include standard contract language plus obligations by the <br />Applicant for maintenance activities for the entire duration of the easement <br />period. The Board authorizes staff to prepare the necessary easement documents <br />and authorizes the Director to execute said documents. It is further <br />recommended that the grantee shall be subject to a non-exclusive clause, shall <br />implement a construction safety program, and shall coordinate activities with all <br />other easements within the subject area. The motion was approved unanimously <br />(9-0). <br /> <br />13. Flood Protection - South Platte River Easement Request - Roxborough Park Metro <br />District <br />Tape 2, Track 3 00: 14:29 - 00:22:49 <br />Action: A motion was made by Eric Wilkinson, and seconded by John Redifer to approve <br />Staffs recommendation that following a review by the AG's Office and CWCB <br />staff for Agenda Item 13, that the Board approve the construction easement and <br />non-exclusive easement request for the Roxborough Park Metropolitan District- <br />Stormwater pipeline relocation in Englewood, Colorado located on CWCB right- <br />of-way. The actual easement needs express assignability to the City of Littleton. <br />The easement fee is considered under Method ill (Special use Consideration), <br />which shall include a total of $500 and other considerations for the easement and <br />application fee. The Board authorizes staff to prepare the necessary easement <br />documents and authorizes the Director to execute said documents. It is further <br />recommended that the grantee shall be subject to a non-exclusive clause, shall <br />implement a construction safety program, and shall coordinate activities with all <br />other easements within the subject area. Instream Flow (ISF) Appropriation Hearing - North Fork Smith Fork Gunnison River <br />Tape I, Track 5 00:3 I :02 - 00:40:33 <br /> <br />Action: <br /> <br />A motion was made by Keith Catlin, and seconded by Don Schwindt to approve <br />Staffs recommendation that the Board take final action on the instream flow <br />appropriation on North Fork Smith Fork Gunnison River. For the stream <br />segment listed on the Agenda Item 14 attached Instream Flow Recommendation <br />Tabulations, the staff recommended that the Board: 1) Determine, pursuant to <br />section 37-92-102(3), CRS, and based upon the recommendations of the DOW, a <br />review of the data and other information presented by Staff, in this and previous <br />memos and orally, and Staffs recommendation for instream flow appropriations <br />on the stream identified that: a) A natural environment does exist on each <br />stream; b) Water is available in each stream and lake for appropriation; c) There <br />is a natural environment that can be preserved to a reasonable degree with the <br />recommended water rights, if granted; (d) The natural environment will be <br />preserved to a reasonable degree by the water available for the recommended <br />appropriations; e) Such natural environment can exist without material injury to <br />water rights. 2) Pursuant to Rule 5f., establish January 25, 2005 as the <br />appropriation date for these instream flow water rights. 3) Request the Attorney <br /> <br />Flood Protection.
