<br />Action: <br /> <br />Based upon the recommendation from Deputy Attorney General Casey Shpall, <br />the remainder of agenda items 8a, 8b, 8c, 8d, 8e, 8j, 9a, and 9b were not recorded <br />pursuant to C.R.S. section 24-6-402(2)( d.5)(l)(B) because they constituted <br />attorney-client privilege. Torn Sharp recused himself from discussion on agenda <br />items 8b and 8d. Attorney General John Suthers joined the Executive Session. <br />The portion of the Executive Session that was not recorded constituted a <br />privileged attorney-client communication. <br /> <br />~ <br /> <br /> <br />The portion of the Executive Session that was not recorded was confined to the <br />topics authorized for discussion in an Executive Session under C.R.S. section 24- <br />6-40 (;J>(a)gp. <br /> <br />K -"\?, <br /> <br />CB Chair <br /> <br /> <br />At the end of Executive Session, a motion was made by Eric Wilkinson, and <br />seconded by John Redifer to end Executive Session. The motion was approved <br />unanimously (9-0). <br /> <br />10. Report from Executive Session <br />Tape I, Track 4 00:01:19-00:03:19 <br />Action: Per Deputy Attorney General Casey Shpall, the items discussed in Executive <br />Session were limited to litigation strategies. A motion was made by Don <br />Schwindt, and seconded by Eric Wilkinson to approve Staffs recommendations <br />of agenda items 6 and 7 that pursuant to ISF Rule 8j, the Board authorize Staff to <br />proceed to trial to protect the Board's instream flow water rights on the Eagle <br />River. The motion passed unanimously (6-0) <br /> <br />1 I. Flood Protection - Chatfield Downstream Channel Improvement Project - Easement Fee <br />Structure Revision <br />Tape I, Track 2 02:15:09-02:36:08 and <br />Tape 1, Track 3 00:00:01 - 00:06:39 <br />Action: A motion was made by Torn Sharp, and seconded by Eric Wilkinson to approve <br />Staffs recommendation that the Board approve the adoption ofthe revised, and <br />further amended Method III Easement Fee Structure to the Chatfield <br />Downstream Channel Improvement Project Easement Fee Structure. The motion <br />was approved unanimously (9-0). <br /> <br />12. Flood Protection - South Platte River Easement Request - Columbine Country Club <br />Tape 2, Track 3 00:00:00 - 00: 14:29 <br />Action: A motion was made by Torn Sharp and seconded by Eric Wilkinson to approve <br />Staff's recommendation that following a review by the AG's Office and CWCB <br />staff for Agenda Item 12, that the Board approve the construction easement and <br />non-exclusive easement request for Columbine Country Club (Golf Course <br />reconstruction) located in Columbine Valley, Colorado. The easement is located <br />on CWCB right-of-way and the easement fee shaH be $75,000 using Method III <br /> <br />Flood Protection. Water Supply Planning and Finance. Stream and Lake Protection <br />Water Supply Protection. Conservation and Drought Planning 4 <br />
