The motion was approved unanimously (9-0). <br />Don Schwindt was not present for the vote. <br /> <br />. <br /> <br />18. Stream and Lake Protection Section - Proposed Water Acquisition, Pine River, La Plata <br />County <br />Tape 2, Track I 03:32:34 - 04:2S:21 <br />Action: Information item; no action taken <br /> <br />19. Stream and Lake Protection Section - ISF Rule 6g Proposed Rulemaking <br />Tape 2, Track 3 01:06:32 - 01:08:43 <br />Action: A motion was made by Don Schwindt and seconded by Keith Catlin to approve <br />Staffs recommendation to schedule an ISF Rule 6g Rulemaking hearing on <br />November IS, 200S from 8:00 am to 10:00 am, appointing Pat Kowaleski as the <br />hearing officer. <br /> <br />The motion was approved unanimously (7-0). Russell George, Tom Sharp, and <br />Travis Smith were not present for the vote. <br /> <br />20. Stream and Lake Protection Section - Uncontested Instream Flow Appropriations <br />Tape 2, Track 3 00:00:00 - 00:03:41 <br />Action: A motion was made by Keith Catlin, and seconded by Don Schwindt to approve <br />staffs recommendation with regard to the instream flow tabulations for Escalante <br />Creek and that the Board: <br />(I) Determine, pursuant to section 37-92-102(3), CRS, and based upon the <br />recommendations of the BLM, a review of the data and other information <br />presented by Staff, that: <br /> <br />. <br /> <br />a) A natural environment does exist on each stream; <br />(b) Water is available in each stream and lake for appropriation; <br />(c) The natural environment will be preserved to a reasonable degree by <br />the water available for the recommended appropriations; <br />(d) There is a natural environment that can be preserved to a reasonable <br />degree with the recommended water rights, if granted; and <br />(e) Such natural environment can exist without material injury to water <br />rights. <br /> <br />(2) And pursuant to Rule Sf, establish January 2S, 200S as the appropriation date <br />for these instream flows water rights. <br />(3) And request the Attorney General's Office to file the necessary water rights <br />applications. <br /> <br />The motion was approved (8-1).
