The applicant will consult with the DOW and the CWCB before and during <br />the construction of the RICD structures to assure that the RICD construction <br />will not injure the natural environment that the ISF protects. <br />4. The Applicant will clarifY in the decree that the Memorial Day and Labor <br />Day Level II flows will occur on Friday, Saturday, Sunday, and Monday. In <br />addition, the Applicant will clarifY in the decree that the Fourth of July Level <br />II flows will occur as follows: 1) if the Fourth of July is on a Thursday, the <br />flows will occur on Thursday, Friday, Saturday and Sunday; 2) ifthe Fourth <br />of July is on a Friday, Saturday, Sunday or Monday, then the flows will <br />occur on Friday, Saturday, Sunday and Monday; 3) if the Fourth of July is on <br />a Tuesday, then the flows will occur on Saturday, Sunday, Monday and <br />Tuesday; and, 4) ifthe Fourth of July is on a Wednesday, then the holiday <br />flows will occur only on Wednesday. <br /> <br />Bob Burr was not present for the discussion and vote, and both Tom Sharp and <br />Barbara Biggs recused themselves from the discussion and vote. The motion was <br />approved unanimously (7-0). <br /> <br />8. Attorney General's Report and Legal Briefing <br />Tape I, Track 3 00:53:59-01:13:08 <br />Action: A motion was made by Eric Wilkinson, and seconded by Don Schwindt to renew <br />the Board's order asking for copies of any settlement agreements that are reached <br />between the participating parties in the Chaffee County RICD, as soon as the <br />agreements are executed or entered into. Bob Burr was not present. The motion <br />was approved unanimously (9-0). <br /> <br />. <br /> <br />After a short break, Bob Burr returned and a second motion was made by Keith <br />Catlin, and seconded by Bob Burr to go into Executive Session regarding agenda <br />items 8a, 8b, 9a, 9b, and 9d, and excluding item 9c. The motion was approved <br />unanimously (10-0). Harold Miskel recused himself from agenda item 8a <br />(Pueblo RICD), and Tom Sharp recused himself from items 8b, and 9a (Upper <br />Gunnison RICD, and Steamboat Springs). <br /> <br />9.
