Silverthorne RICD Deliberations Continued <br />Tape I, Track 3 00:32:44 - 00:53:59 <br />Action: A motion was made by Travis Smith and seconded by Eric Wilkinson to accept <br />the staff's revised recommendations and findings or fact for the RICD <br />application by the Town of Silverthorne, with some minor changes to the <br />"Findings of Fact" to change paragraph I.a.iii. to state that '''The RICD is in close <br />proximity to suitable upstream points of diversion and upstream storage that may <br />put available, unappropriated water to consumptive beneficial use." The staff <br />recommendations were to make any changes about ramping rates, as may be <br />recommended by the Staff at the Board meeting, and to authorize the Staff and <br />the Attorney General's Office to send the attached revised findings and <br />recommendations to the Water Court for Water Division No.5 before the <br />September 16, 2005 deadline. The revised recommendations and findings offact <br />included the following recommendations: <br /> <br />~ <br /> <br />The Board recommends that the Water Court grant the Applicant a decree that is <br />consistent with the proposed decree provided by the Applicant, as long as the <br />Applicant has complied with the following conditions, or the Applicant has <br />included tenns and conditions in the proposed decree that address the following <br />conditions: <br />I. The Applicant shall provide all ofthe necessary information to demonstrate <br />that the RICD reach will not affect flooding, flood control, or the one <br />hundred year flood elevations. <br />2. The Applicant will include a tenn and condition regarding ramping rates <br />included in the Proposed Decree, and as further clarified by the DOW that <br />the ramping language should apply to all three holiday weekends, such that if <br />the Applicant places a call starting at 7:00 am on a Friday of a holiday <br />weekend, then the applicant will consult with the DOW, Trout Unlimited, <br />and Denver Water to determine how the Applicant will ramp up to the <br />appropriate flow amount beginning at 7:00 am on that first day of the holiday <br />weekend (i.e. the Applicant is not seeking, and the Board does not endorse <br /> <br />Flood Protection.
