<br />e <br /> <br />- <br /> <br />- <br /> <br />above the dam diverts water from Culbera Creek, Vallejos Creek, and San Francisco <br />, Creek into the reservoir. While these diversions have provided flood control benefits <br />to downstream property owners for 81 years, the lower flows in these creeks have also <br />allowed sediment to fill in the channels. If restrictions on the reservoir limit the <br />diversions, property owners on these creeks will be at risk, especially considering the <br />high snowpack this year. Duncan pointed out the deficiencies in this situation with HB <br />1131, the dam safety emergency bill, and suggested a part of the construction fund also <br />be set aside annually for flood emergencies. Discussion followed by Sheftel, Smith, <br />Meyring, Duncan. Harrison. Evans, Simpson, and Martineau. There was consensus to <br />allow Duncan to pursue the matter with the Legislature. <br /> <br />17b. Construction Fund, Sanchez Reservoir. Approval of Contract (10:14.10:32 a.m.) <br /> <br />Sara Duncan reviewed a proposed contract with the dam owners. The Board will be <br />authorized to expend up to $400,000. Jennifer Gimbel, AG staff, indicated security for <br />the loan was 100% interest in the reservoir. Keith Eberhardt. CWCB staff. outlined <br />the plan developed from discussions with the owners who need a loan from the Board <br />to pay for $50,000 in emergency repairs, an unspecified amount to refinance the <br />outstanding balance on a $90,000 short term loan with a local bank for earlier repairs <br />to the gate house and outlet works, and about $250,000 to conduct a feasibility study <br />and pay for construction of permanent repairs. There was discussion by Harrison. <br />Eberhardt, ShefteI, and Duncan. <br /> <br />A motion was made by Harrison and seconded by Meyring to go ahead with the <br />contract for the payback of the emergency, to roll over the earlier loan. and to do a <br />feasibility study. Norton suggested the motion be amended to be contingent on not <br />finding any legal problems in the contract. This was acceptable to the maker and <br />second of the motion. Considerable discussion on the security and scope of the loan <br />followed by Sheftel, Eberhardt, Martineau, Duncan. Olson, and Harrison. Larry Lang, <br />CWCB staff, suggested that the motion include a reference that the money is for <br />emergency repair of a dam which provides flood control benefits. This would facilitate <br />the possibility of receiving any federal assistance if needed. The motion was amended <br />and seconded to recognize the emergency nature of the situation due to a potential <br />flood hazard. The amended motion passed by unanimous (8-0) decision. <br /> <br />16. Review of SB 87., continued (10:33. 10:36 am.) <br /> <br />f. Closed Basin Mitigation (added) <br /> <br />Sara Duncan reviewed an amendment to SB 92-87 for funds to complete <br />construction of Head-San Luis Lakes Recreation Area and answered a question <br />about the park asked by ShefteL <br /> <br />May 1992 Meeting, page 11 <br />
