There were other arrangements made with <br />the D V1sion of Wildlife and the Bureau of Sport Fisheries in cOL,ilection <br />with certain diversions that were not specified in the operating prin- <br />ciples. They are an agreed procedure with the project. As I recall, <br />they are higher than what Pitkin county claimed at certain points. <br />Pitkin county filings did not compute in some of the tributary inflow <br />on Hunter Creek. <br /> <br />Mr. Hobbs: It jus t seems to me that if we don't right now have a <br />challenge as to the adequacy or the inadequacy of the scientific method <br />by which the Division went about this, there is a future right to <br />protest, which is always available. <br /> <br />Number two, it seems to me the board has not made the basic decision as <br />to whether or not to make these filings. I will ask Mr. Moses whether <br />it wouldn't be in the state's interest to go ahead on some of these <br />projects. <br /> <br />Mr. Moses: The only ones that I would recOllllllend at this time would be <br />for Hunter Creek and tributaries. Under our law, any application in <br />the year 1975 has the same priority as any other application filed in <br />1975. So it doesn't make any difference whether we file these today <br />or in Mayas far as the state's interest is concerned or if we file <br />them December 31. My personal reaction is I would rather get these <br />matters disposed of by negotiation rather than litigation. I hope that <br />is the board's posture too. <br /> <br />Mr. Stapleton: To get this matter to some conclusion, I will entertain <br />a mot1.on that Midway Creek, Hunter Creek and tributaries be approved <br />at this meeting, as follows: <br /> <br />1. Midway ereek from Fry"Ark collection system to confluence with <br />.. -'Hunter-Creek - 2.5 cfs year-round. <br /> <br />2. No Name Creek from Fry-Ark collection system to confluence with <br />Hunter Creek - 3 cfs year-round. <br /> <br />3. Hunter Creek from Fry-Ark collection system to conflueace with <br />Midway Creek - 8.5 cfs year-round. <br /> <br />4. Hunter Creek from confluence with Midway Creek to conf;Lue;~ce ,w;Lth <br />No Name Creek - 11 cfs year-round. ", , <br /> <br />5.
