Mr. s~arks: Not necessarily. There were other arrangements made with
the D V1sion of Wildlife and the Bureau of Sport Fisheries in cOL,ilection
with certain diversions that were not specified in the operating prin-
ciples. They are an agreed procedure with the project. As I recall,
they are higher than what Pitkin county claimed at certain points.
Pitkin county filings did not compute in some of the tributary inflow
on Hunter Creek.

Mr. Hobbs: It jus t seems to me that if we don't right now have a
challenge as to the adequacy or the inadequacy of the scientific method
by which the Division went about this, there is a future right to
protest, which is always available.

Number two, it seems to me the board has not made the basic decision as
to whether or not to make these filings. I will ask Mr. Moses whether
it wouldn't be in the state's interest to go ahead on some of these
projects.

Mr. Moses: The only ones that I would recOllllllend at this time would be
for Hunter Creek and tributaries. Under our law, any application in
the year 1975 has the same priority as any other application filed in
1975. So it doesn't make any difference whether we file these today
or in Mayas far as the state's interest is concerned or if we file
them December 31. My personal reaction is I would rather get these
matters disposed of by negotiation rather than litigation. I hope that
is the board's posture too.

Mr. Stapleton: To get this matter to some conclusion, I will entertain
a mot1.on that Midway Creek, Hunter Creek and tributaries be approved
at this meeting, as follows:

1. Midway ereek from Fry"Ark collection system to confluence with
.. -'Hunter-Creek - 2.5 cfs year-round.

2. No Name Creek from Fry-Ark collection system to confluence with
Hunter Creek - 3 cfs year-round.

3. Hunter Creek from Fry-Ark collection system to conflueace with
Midway Creek - 8.5 cfs year-round.

4. Hunter Creek from confluence with Midway Creek to conf;Lue;~ce ,w;Lth
No Name Creek - 11 cfs year-round. ", ,

5. Hunter Creek from confluence with No Name Creek to confluence with
Roaring Fork River - 14 cfs year-round.

Mr. Kroeger: I so move.

Mr. Sta11eton: It has been moved and seconded. Is there any
