No. 132 <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />January 31, 1979 <br /> <br />R E S 0 L UTI 0 N <br /> <br />WHEREAS, the United States Army Corps of Engineers, <br />Omaha District, completed in April, 1977, a floOdplain information <br />report entitled "Special FloOd Hazard Information Report, South <br />Platte River, Volume I, Weld County, Colorado"; and <br /> <br />WHEREAS, the Colorado Water Conservation Board, as <br />requested by the Board of County Commissioners of Weld county, by <br />resolution adopted November 11, 1977, approved and designated the <br />floodplains described in the April, 1977, report; and <br /> <br />WHEREAS, a new report entitled "Flood Insurance Study, <br />city of Fort Lupton, Colorado," which includes floodplain informa- <br />tion and data for the South Platte River, dated October, 1978, has <br />been prepared by Gingery Associates, Inc., under contract with the <br />Federal Insurance Administration; and <br /> <br />WHEREAS, said report describes and outlines the floodplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; and <br /> <br />WHEREAS, the city of Fort Lupton has requested the <br />Colorado Water Conservation Board to designate and approve the <br />floodplain areas as set forth in the aforesaid report; and <br /> <br />WHEREAS, Section 37-60-106(1), Colorado Revised Statutes <br />1973, requires the Colorado Water Conservation Board to assist in <br />the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-201 and 30-28-111, Colorado <br />Revised Statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation Board; <br />and <br /> <br />WHEREAS, Section 37-60-106(1) (c), Colorado Revised <br />Statutes 1973, directs the Colorado Water Conservation Board to <br />designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of <br />lOcal jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said revised <br />information and data and does hereby recommend to the Colorado <br />Water Conservation Board that the Board designate and approve as <br />floodplain areas those areas inundated by a 100-year flood <br /> <br />APPENDIX I <br />
