<br />I <br /> <br />Insofar as deviation from the above princi- <br />ples may have hereto for or may hereafter become <br />embodied in any law, rule, regulation or prac- <br />tice, Denver reserves the right to continue to <br />work for the repeal or adjustment of such law, <br />rule, regulation or practice, to require its <br />conformance to the basic principles above refer- <br />red to. Denver does not consider itself to have <br />waived or to be estopped from the exercise of <br />this privilege by virtue of the exercise of its <br />own choice of timing for implementing its efforts <br />to secure adherence to the basic principles <br />above referred to unless it shall have done so <br />by the official and deliberate action of the <br />Board of Water Commissioners of the City and <br />County of Denver.' <br /> <br />Making an application to the exact situa- <br />tion as at present, we examined with great care <br />the letter which had been prepared by Mr. Spen- <br />cer and after that examination, telephoned him <br />and made a record of that conversation, a copy <br />of which has not yet been transmitted to him <br />because this occurred very recently. We were <br />well pleased - very much pleased - with Mr. <br />Spencer's views as to the scope of the possible <br />investigation. The City of Denver owns a decree <br />to the waters of the South Platte River as they <br />flow through the Two Forks Reservoir site dated <br />in 1904. Denver owns rights from the United <br />States Government with respect to the right to <br />fill this reservoir and also owns a very sub- <br />stantial part of all the land needed to build <br />the reservoir. <br /> <br />I <br /> <br />The question asked about the capacity of <br />the reservoir is of great importance to Denver <br />because, in any development, we would envision <br />a coordinated development with the City of Denver <br />so that this reservoir might be a completely <br />multi-purpose reservoir, sharing not only for <br />Denver's needs and for the flood control needs <br />and general storage needs in the South Platte <br />Valley, but also for power generation, and <br />recreation requirements of this very heavily <br />populated area of our state. <br />
