<br />.. . <br /> <br />261 <br /> <br />"(b) "Eastern Colorado" means that portion of the State of <br />Colorado lying within the natural drainage basin of the Arkansas <br />River. <br /> <br />,,( c) I~'{estern Colorado" means that portion of the State of <br />Colorado lying ,vithin the natural drainage basin of the Colorado <br />River and served by diversions nade fron the Colorado. River, or its <br />tributaries, above its confluence vnth the Gunnison River. <br /> <br />,,( d) "Eastern Colorado Conservancy District" means that <br />entity to be hereafter created to contract for payment to the <br />United States of an appropriate portion of project costs allocated <br />to certain ,vater uses in Eastern Colorado. <br /> <br />"( e) "Aspen' Reservoir" means not only the reservoir presently <br />planned for construction near the town of Aspen as part of the pro- <br />ject but also, unless the context requires otherwise, any other <br />reservoir that may be constructed in Western Co10rado above the <br />tmvn of Aspen in lieu of that reservoir for the purpose of pro- <br />tecting water uses in Western Colorado. <br /> <br />"( f) "C.f.s." means cubic feet of water per second of time. <br /> <br />"2. The Aspen Reservoir shall be constructed and maintained on <br />the Roaring Fork River above the town of Aspen, Colorado, with an active <br />capacity of about 28,000 acre-feet and ,vith a reasonable expectancy that <br />it will fill annually. The 28,000 acre-feet of water stored therein <br />shall be available for replacement purposes in Western Colorado. All <br />of such stored water shall be released under the conditions and limi- <br />tations hereinafter set forth. <br /> <br />"3. The cost of construction and perpetual operation and main- <br />tenance of the Aspen Reservoir shall be a charge aGainst the project <br />and shall be paid from project revenues or as othe~vise provided by <br />the Congress of the United States. <br /> <br />"4. The Aspen Reservoir shall be completed before any water is <br />diverted to Eastern Colorado by means of the project. <br /> <br />"5. The primary purpose of Aspen Reservoir is to furnish, in <br />like manner as if the project were constructed by a water conservancy <br />district organized pursuant to the laws of the State of Colorado, the <br />water required for the protec~jon of Western Colorado water users by <br />the provisions of Section 1, Chapter 192, Colorado Session Laws, 1943, <br />reading as follows: "provided, hcmever, that any works or facilities. <br />planned and designed for the exportation of water from the natural basin <br />of the Colorado River and its tributaries in Colorado, by any district <br />created under this chapter, shall be subject to the provisions of the <br />Colorado River Compact and the Boulder Canyon Project Act, as amended; <br />that any such works or facilities shall be designed, constructed and <br />operated in such a manner that 'the present appropriations of water, and <br />in addition thereto prospective uses of water for iFrigation and other <br /> <br />-I <br /> <br />t <br /> <br />I <br />
