The project will be operated in such a manner that those in <br />Eastern Colorado using project water inported from the Colorado River <br />Basin for domestic purposes shall have preference over those claiming <br />or using water for any other purpose. <br /> <br />"13. The project is to be operated in such a manner as to secure <br />the greatest benefit from the use and re-use of imported project waters <br />,vithin the project boundaries in the State of Colorado. <br /> <br />."lh. Any and all benefits and rifhts of Western Colorado water <br />users in and to ,vater stored in Green Mountain Reservoir, as described <br />and defined in Senate Document BO, Seventy-fifth Congress, First Session, <br />shall not be impaired or diminished by this project. <br /> <br />I <br /> <br />-"15. The project, its operation, maintenance, and use shall be <br />subject to the provisions of the Upper Colorado River Basin Compact of <br />October 11, 19hB (Public Law 37, Blst Congress, First Session), the <br />Colorado River Compact of November 24, 1922 (House Document 605, 67th <br />Congress, Fourth Session), and the Boulder Canyon Project Act of <br />December 21, 192B (h5 Stat. 1057-1064). In the event any curtailment <br />of use of Colorado River water in the State of Colorado is necessary to {, <br />sati~fy the provisions of the Colorado River Compact or the Upper Colorado' <br />River Basin Compact, then the diversions by the project for use in Eastern <br />Colorado shall be curtailed before there is any curtailment of the right <br />to store water in Aspen Reservoir in a quantity not in excess of the capacity <br />of that reservoir for use in Western Colorado in accol~ance ,vith these <br />operating principles. <br /> <br />-.. <br /> <br />"16. The Secretary of the Interior shall at any time have the option <br />to obtain or require the transfer to the United States of any and all rights <br />initiated or acquired by the appropriation or use of water thrOUGh the <br />works of the project in Eastern Colo,ado, except vested rights to present <br />appropriations; provided, hcwrever, that ~~e title so taken shall be subject <br />to a beneficial use of such water as may be provided in the paJT.1ent contract <br />or contracts. The rights to store water in Aspen Reservoir under the appli- <br />cable laws of the State of Colorado shall be initiated and acquired Qy and <br />held in the name of the United States pursuant to those laws. <br /> <br />"17. To assure project operation in confonnity vlith the operating <br />principles heretofore stated, to provide a means for the collection and <br />interchange of information, and to provide a method for the continued <br />study of project operations to the end that, if the stated operating <br />principles may be improved upon, recommendations for changes may be <br />made to the contracting parties, a commission shall be created in an <br />appropriate manner to be composed of one representa~ive of the Eastern <br />Colorado Conservancy District, one representative of the Colorado River <br />Water Conservation District, two representatives of the qnited States, <br />and one representative of the State of Colorado appointed by the Colorado <br />Water Conservation Board after consultation with the Colorado Game and <br />Fish Commission. The powers of such commission shall be limited to the <br />collection of data, the makinG of findings of fact, and th~ suggestion <br />of changes in operating principles." <br /> <br />I <br /> <br />,I <br />
