<br />- - . <br /> <br />266 <br /> <br />"No charge shall ever be imposed for water released from, or made <br />available by reason of releases from, the replacement capacity of the <br />Aspen Reservoir. <br /> <br />"7. That portion of the total capacity of the Aspen Reservoir not 1 <br />needed as replacement capacity constitutes surplus capacity. Water stored <br />in such surplus capacity may be sold or leased by the United States to <br />water users in TIestern Colorado. Charges for the use of such water shall <br />be comnarable to charges for use of project TIater for similar purposes in <br />Eastern Colorado rdth appropriate adjustment for the repayment ability <br />of such l'rater users. If it hereafter a?pears that the cost of procudng <br />water, from sources other than the surplus capacity of the Aspen Reservoir, <br />for the same uses as those to TIhich \vater from the surplus capacity of the <br />reservoir is to be made available shall have been increased bJ" reason of <br />the construction and operation of the project, then the charges for water <br />released from the'surpltlS capacity shall be dimL~ished by the amount of <br />such increase.in cost. <br /> <br />"8. Project diversions from Lime Creek shall be made only in the <br />months of !.lay and June of each year. <br /> <br />"9. To protect recreational values, including fiShing, no diversions <br />from '[estern Colorado will be made which reduce the remaining aggregate <br />stream flo\'/s to less than either of the following minimum standards: <br /> <br />"( a) The Fryingpan collection system at the points of <br />diversion,collectively, exclusive of Lime Creek --- 15 c.f.s. <br />October 1 through March 31; 30 c.f.s. April 1 through Sep- <br />tember 30; <br /> <br />"( b) Near Norrie (immediately below the junction of North <br />Fork and Fryingpan River)--30 c.f.s. October 1 throueh March 31; <br />100 c.f.s. April 1 through April 30; 150 c.f.s. May 1 through <br />ray 31; 200 c.f.s. June 1 through June 30; 100 c.f.s. July 1 <br />through July 31; 75 c.1.s. AUQlst 1 through August 31; 65 c.1.s. <br />September 1 through September 30. <br /> <br />"In maintaining the above ninimmn standards, t he project diversions <br />shall be regulated, so far as is practicable, in such a,manner that' <br />the Horth Fork, the FryinGpan River, and each of the tributaries of <br />those streams, shall contribute to the residual stream flows requi red <br />by those minimum standards qUQlltities of water in proportion to their <br />na turnl contributions. <br /> <br />1- <br /> <br />"lJ. An appropriate written contract shall be nade l'lhereby the Twin <br />Lakes Reservoir and Canal Company shall refrain from diverting water <br />whenever the natural flow of the RoarinG Fork River and its tributaries <br />shall be only sufficient to maintain a flow equal to or less than that <br />required to maintain the recommended averaGe flmvs in the Roaring Fork <br />River at the head of the proposed Aspen Reservoir in a quantity pro- <br />portionate to the respective natural contrih'ltions of those streams <br />from ~hich diversions are made to the natural flow of the Roarine Fork <br />River. The recommended average floVls above mentioned are flev!s in <br />quantities equal to those recommended as a minimum at the head of the <br />
