Identification of persons requesting Party Status:

High Country Citizens' Alliance
Post Office Box 1066
Crested Butte, CO 81224
(970) 349-7104

2. Identification of recommendations at issue:

Recommendations presented by staff and adopted by the Board at the January 2002 Board
meeting, for Iron Fen, as shown on the attached Exhibit A.

3. Brief and plain statement of the reasons HCCA seeks Party status and contested facts:

- HCCA emphasizes that it supports the CWCB's efforts to preserve the very unique aquatic
features of the Mount Emmons Iron Fen to a reasonable degree and whether natural lake level of
9,750 (or 9,551.4) feet above sea level, is sufficient for that protection.

- Whether or not water is physically available to support the natural lake level recommended by the
CWCS staff.

- Whether or not the lake level recommended by the CWCBstaff would cause injury to water rights
of others.

- Whether or not the CWCB staff recommendation of a natural lake level of 9,750 feet is sufficient,
where the Division of Wildlife ("DOW") recommendation states the need for "all of the water present
in the fen" and an associated water elevation of 9 ,551.4 feet above mean sea level.

- Whether or not the CWCS staff recommendation of a natural lake level of 9,750 (or 9,551.4) feet
is sufficient, where USFS filed for 0.2 cfs for the Mount Emmons Iron Bog Springs (supplying water
to the Iron Fen) in 1999. .

P,O.
