The motion was seconded by Eric Kuhn and approved unanimously <br />(8-0). <br /> <br />7b. Case Nos. l-9lCW125 and l-94CW063; Central City <br />Tape I,Start/Stop: 3891 - 4160 <br />Action: A motion was made by Patricia Wells that the Board adopt by resolution approval of <br />the broadening of the opposition into all three cases. The motion was <br />seconded by David Smith and approved unanimously (8-0). The motion was <br />then admended to include the latitude that if the staff felt the need to <br />intervene, then they could. The amended motion was approved unanimously <br />(8-0). <br /> <br />8. Executive Session <br /> <br />8a. It was decided that 8bvii was <br />not to be discussed in Executive Session. 8bx was deleted since the judge <br />had not made a ruling. Patricia Wells recused herself from item 8bi. Jim <br />Lochhead recused hinself from 8bii. David Harrison recused hinself from <br />8biii and 8bxi (Snowmass). Regarding the items concerning instream flows, <br />a motion was made by Jim Lochhead that the Board authorize the Attorney <br />General's Office to file or support a motion for consolidation assuming that <br />such a motion would be acceptable and not jeopardizing sufficient progress <br />in the recovery plan and pending confirmation of no significant legal issues <br />with other objectors in those cases.
