<br />A motion was made by Alan Hamel that the Board should file an amicus <br />brief supporting the legality of operating principles. Patricia Wells seconded <br />the motion and it was approved unanimously (9-0). <br /> <br />A motion was made by Eric Kuhn that the Board instruct the Attorney <br />General to meet with the Cities of Grand Junction and Clifton and to clarify <br />on the Board's behalf that it is not the Board's intent to prohibit those entities <br />from making any changes to their existing ditch rights to municipal use. The <br />motion was seconded by David Harrison and approved unanimously (10-0). <br /> <br />A motion was made by Eric Kuhn that the Board accept the Stipulation as <br />drafted with the Forest Service as presented by Carol Angel of the Attorney <br />General's Office during executive session, with a couple of minor <br />adjustments to the wording. The motion was seconded by Alan Hamel and <br />approved unanimously (10-0). <br /> <br />A motion was made by Ray Wright that the Board adopt the staff <br />recommendation on agenda item 9a, the final notice for the Board's in stream <br />flow filing on East Middle Creek, but with the direction to the AG's office <br />that they should not file this application with the Water Court before the <br />December 1, 1995, and to not file the application with the Water Court <br />without the approval of the Board. The motion was seconded by David <br />Harrison and approved unanimously (10-0). <br /> <br />A motion was made by Ray Wright that the AG's office enter into the <br />proposed stipulation with the Forest Service regarding their forbearance in <br />pursuing their own application on their East Middle Creek Filing at this time. <br />The motion was seconded by Alan Hamel and approved unanimously (10- <br />0). <br /> <br />A motion was made by Patricia Wells that the Board join the brief of the <br />State Engineer's Office urging the court to reconsider its ruling, and that the <br />brief emphasize the Board's particular policy concerns in regard to the court's <br />ruling.
