<br />1071 <br /> <br />I <br /> <br />In order to assist you in passing on the creation of <br />this proposed Commission, the nominees named above met in Den- <br />ver, Colorado, on July 29, 1958, to provide a detailed explana- <br />tion of the Commission's functions. Present were nominees <br />Barnard, Jex, Nichols, Saunders, Bunger and Barkley, and alter- <br />nates Smith, Fisk, Miller and Clayton. The meeting was presided <br />over by John B. Barnard, Jr., Chairman of the Colorado Water <br />Congress. <br /> <br />It will be noted from the list of nominees that the <br />interested districts and the City of Denver have nominated, <br />either as nominee or alternate, the heads of their legal or <br />engineering staffs, or the counsel and engineer for the enti- <br />ties. Mention is made of this to show you that the constituent <br />agencies are so eager to be of service to the Colorado Water <br />Conservation Board through the creation of this Commission and <br />the making of the recommended studies that they would assign <br />these men to this task, thus making available to you many decades <br />of education, experience, and active participation in water law <br />and engineering. <br /> <br />It is our feeling that the functions of this Commis- <br />sion are to correlate available data, develop data where nec- <br />essary, and bring careful legal consideration to bear on many <br />unsolved legal problems in the areas of study outlined in the <br />statement presented to the Board in the Durango meeting. When <br />the reports of this Commission are presented to the Board, it <br />is felt that this procedure will give to the Board the legal <br />and engineering solutions to some very complicated problems, <br />thus enabling the Board to consider its policy decisions in <br />light of the combined thinking of legal and engineering techni- <br />cians throughout the state. In addition, the participation <br />by persons nominated by the various districts gives strong <br />reason to believe that the ultimate results will have the con- <br />currence of agencies representing more than 90% of Colorado. <br /> <br />This brief explanation is made in order to assure the <br />Board that the objective of this Commission is to give support <br />and assistance to the Board in performing its duties, and not <br />to encroach upon its functions or perogatives in any respect <br />whatsoever. <br /> <br />I <br /> <br />It is our feeling that the function of the proposed <br />Commission is: <br /> <br />1.
