<br />e <br /> <br />- <br /> <br />e <br /> <br />F. <br /> <br />Legal Descriptions: Sprucedale Ditch is located in the <br />NE 1/4 NW 1/4 of Section 28, Township 5 South, Range 71 <br />West, 6th P.M., Jefferson County, Colorado, the <br />headgate of which is located at a point whence the <br />North Quarter Corner bears North 51010 I 05" East, 720.05 <br />feet. <br /> <br />3.3 Water stored. pursuant to the December 30, 1994, <br />appropriation date adjudicated herein to Sprucedale Reservoir, or <br />exchanged into Sprucedale Reservoir pursuant to the appropriative <br />right of substitution and exchange decreed herein (or other <br />decreed appropriative right of substitution and exchange), may be <br />used for all decreed purposes, including augmentation and <br />replacement of depletions associated with operation of wells used <br />to serve the Cragmont and Mountain Park Homes Subdivisions. <br /> <br />3.4 MMRC and Buffalo Park seek a water storage right for <br />Meadowview Reservoir for augmentation, replacement and exchange <br />purposes. Meadowview Reservoir, alkla Evergreen Memorial Park <br />Lake No. 2 was originally decreed in Case Nos. W-6656-72 and <br />87CW323 for several nonconsumptive uses with Evergreen Memorial <br />Park, Inc. as the Applicant. Evergreen Memorial Park, Inc. has <br />determined that the conditional water storage rights decreed in <br />Case Nos. W-6656-72 and 87CW323 to the Evergreen Memorial Park <br />Lake No. 2 will no longer be pursued. Therefore, the conditional <br />storage decrees previously awarded to the Evergreen Memorial Park <br />Lake No. 2 are hereby cancelled. The conditional storage right <br />claimed herein can be described as follows. Notwithstanding this <br />adjudication, Meadowview Reservoir shall be constructed to a <br />physical capacity of at least 49.3 acre feet: <br /> <br />A. <br /> <br />Name of structure: Meadowview Reservoir, <br />Evergreen Memorial Park Lake No. 2 <br /> <br />a/k/a <br /> <br />B. Legal description: To be located in the NE 1/4 SW 1/4 <br />and the NW 1/4 SE 1/4 of Section 26, Township 5 South, <br />Range 71 West, 6th P.M., Jefferson County, Colorado, <br />with the reservoir inlet located at a point 2,470 feet <br />East and 3,520 feet South of the NW corner of said <br />Section 26 and the reservoir outlet located at a point <br />3,000 feet East and 3,800 feet South of the NW corner <br />of said Section 26. <br /> <br />C. Source of water: North Turkey Creek, surface runoff <br />and springs. Wells will not be used to fill the <br />Reservoir. <br /> <br />D. Date of appropriation: December 30, 1994. <br /> <br />E. Amount of water: 30 acre feet per year, CONDITIONAL. <br /> <br />F. <br /> <br />Use of water: Augmentation, replacement, exchange and <br />substitution purposes. <br />11 <br />
