Buffalo Park Development <br />Company, Colorado Mountain Properties, Inc. and Evergreen Memorial <br />Park, Inc. are the owners of property described in Paragraph No. <br />1.9 herein. Buffalo Park Development Company has agreements with <br />Colorado Mountain Properties, Inc. and Evergreen Memorial Park, <br />Inc. .to provide water for development within the properties <br />described in Paragraph No.1. 9. For convenience, Buffalo Park <br />Development Company; Colorado Mountain Properties, Inc. and <br />Evergreen Memorial Park, Inc. shall collectively be referred to <br />herein as "Buffalo Park." To the extent a specific obligation is <br />incurred by Buffalo Park Development Company, it will be referred <br />to as " the Buffalo Park Company." At the time the September 12, <br />1994, Agreement was signed, North Fork Associates was the owner of <br />certain water rights decreed to the Warrior Ditch, the Harriman <br />Ditch and Soda Lakes Reservoir Nos. 1 and 2. Title to such water <br />rights has now been conveyed to MMRC. Buffalo Park proposes to <br />develop several subdivisions in the Turkey Creek and Bear Creek <br />drainage basins which will utilize ground water from tributary <br />wells, or direct diversions from a surface stream as the primary <br />water supply. MMRC will provide necessary augmentation and <br />replacement water to allow diversions on a year around basis. <br />MMRC will also oversee the operation of the plans for augmentation <br />and appropriative rights of substitution and exchange described <br />herein. <br /> <br />OVERVIEW OF DEVELOPMENTS PROPOSED BY BUFFALO PARK: <br /> <br />1.9 The developments <br />located in Western Jefferson <br />as follows: <br /> <br />to be served by Buffalo Park are <br />County and can generally be described <br /> <br />3 <br />
