Action: Background Briefings were made by members of the Attorney General's
Office, and public comment was heard. A motion was made by Janice
Sheftel that the Board go into Executive Session to discuss the subjects
listed in this Agenda Item. The motion was seconded by Patricia Wells and
approved unanimously (9-0), and the Board went into Executive Session.

Action: A motion was made by Eric Kuhn that, acting upon the recommendation
from the Attorney General's Office, the Board waive its privilege on the
1/26/99 memo relating to the quantification of the National Park Service
Reserved Water Right for the Black Canyon of the Gunnison. As a result,
this memo will be available for public review. The motion was seconded by
Bill Brown and approved unanimously (9-0).

lOb. Water Project Construction Loan Program - General and Financial Matters - Town
of Erie - Request for Parity.

Action: A motion was made by Janice Sheftel that the Board postpone the question
of parity for the Town of Erie, and instruct the staff review the parity policy,
and that if the Board then adopts a different policy, it would reconsider the
question of the Town of Erie's parity status. The motion was seconded by
Eric Kuhn and approved unanimously (10-0).
